Welcome to EcoTurf Design & Build (“EcoTurf,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website ecoturfdesignbuild.com, your communications with us, and our delivery of outdoor design, landscaping, hardscape, artificial turf, and related services in the Dallas-Fort Worth Metroplex and surrounding communities.
By using our website, requesting a consultation, or engaging us to perform services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. About EcoTurf Design & Build
EcoTurf Design & Build is a Texas-based outdoor design and installation company offering services including, but not limited to, artificial turf installation, landscape design, paver patios, walkways and driveways, retaining walls, custom pergolas and shade structures, fire pits and outdoor fireplaces, pet turf, play turf, putting greens, and full outdoor living design and build services.
We operate primarily within the Dallas-Fort Worth Metroplex and surrounding communities. Service availability outside this area is at our sole discretion.
2. Use of the Website
You agree to use our website only for lawful purposes and in a manner that does not violate the rights of others or restrict their use of the website. You agree not to:
- Use the website to transmit harmful, harassing, or unlawful content
- Attempt to gain unauthorized access to any portion of the website, our servers, or any associated systems
- Use any automated tools (bots, scrapers, crawlers) to access the website without our prior written consent
- Reproduce, copy, modify, or redistribute any portion of the website or its content without permission
- Submit false, inaccurate, or misleading information through any contact or quote form
- Interfere with the security or proper functioning of the website
We reserve the right to refuse service, restrict access, or terminate your use of the website at our sole discretion.
3. Free Consultations and Quotes
EcoTurf offers free design consultations and project estimates. Submitting a consultation request through our website does not create a binding contract. A consultation request indicates your interest in receiving information and a non-binding estimate from us.
Estimates and quotes are valid for the period stated within the document, typically 30 days from the date of issue, unless otherwise specified in writing. Pricing may change after expiration based on material costs, site conditions, scope adjustments, or market factors.
All estimates are based on information provided by the client and an initial site visit. Final pricing may be adjusted following a detailed site assessment, soil conditions, code requirements, or scope changes requested by the client.
4. Service Agreements and Project Contracts
Any project undertaken by EcoTurf will be governed by a separate written Service Agreement or Project Contract executed between EcoTurf and the client. The Service Agreement will detail:
- Scope of work and deliverables
- Project timeline and milestones
- Total project cost, payment schedule, and accepted payment methods
- Materials, products, and warranty terms
- Change order procedures
- Cancellation and refund terms specific to that project
In the event of a conflict between these Terms of Service and a signed Service Agreement, the terms of the signed Service Agreement will prevail with respect to that specific project.
5. Payment Terms
Payment terms are specified in each individual Service Agreement and typically include:
- A non-refundable deposit upon signing the agreement
- Progress payments tied to project milestones
- Final balance due upon project completion
Accepted payment methods include check, ACH transfer, and major credit cards. Credit card payments may be subject to a processing fee. Late payments may accrue interest at the maximum rate permitted under Texas law.
Failure to make timely payments may result in suspension of work, project delays, lien filings as permitted by Texas Property Code, and recovery of collection costs and attorney’s fees.
6. Site Access and Client Responsibilities
By engaging EcoTurf, the client agrees to:
- Provide safe and reasonable access to the work site during agreed-upon working hours
- Disclose all known underground utilities, irrigation lines, septic systems, and other site conditions
- Obtain any required HOA approvals before work begins
- Secure pets, children, and valuable property during work hours
- Ensure adequate water and electrical access where required for installation
- Notify EcoTurf of any property restrictions, easements, or boundary disputes
EcoTurf is not responsible for damage to undisclosed underground utilities, sprinkler systems, or items not visible during the standard site assessment. Texas law (Texas Health & Safety Code Chapter 251) requires utility location through Texas811 (call 811) prior to excavation; we coordinate this where applicable.
7. Permits, Codes, and HOA Approvals
Some projects may require permits, code compliance inspections, or homeowners’ association (HOA) approvals. Unless explicitly stated in the Service Agreement, the client is responsible for:
- Obtaining HOA approval prior to project start
- Disclosing any deed restrictions, covenants, or local ordinances that may affect the project
- Reimbursing EcoTurf for permit fees if not included in the original quote
EcoTurf will assist with permit applications and code compliance where contracted to do so but cannot guarantee approval timelines or outcomes from third-party authorities.
8. Warranties
EcoTurf provides warranties on workmanship and installed materials as specified in each Service Agreement. Manufacturer warranties on materials (turf, pavers, structures, etc.) pass through to the client and are governed by the respective manufacturer’s terms.
Warranties do not cover:
- Damage caused by misuse, neglect, or lack of reasonable maintenance
- Damage from acts of nature, including but not limited to flooding, hail, severe storms, or extreme temperatures
- Damage from rodents, pests, pets digging, or unauthorized modifications
- Normal wear and tear
- Issues arising from work performed by parties other than EcoTurf
Warranty claims must be submitted in writing to info@ecoturfdesignbuild.com within the warranty period. EcoTurf reserves the right to inspect the claim before performing any warranty work.
9. Limitation of Liability
To the fullest extent permitted by Texas law, EcoTurf’s total liability for any claim arising out of or relating to these Terms, the website, or any project shall not exceed the total amount paid by the client for the specific project giving rise to the claim.
EcoTurf shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of use, loss of data, or property damage beyond the scope of our work, even if advised of the possibility of such damages.
Nothing in these Terms limits liability that cannot be limited under applicable Texas or federal law, including liability for gross negligence or willful misconduct.
10. Indemnification
You agree to indemnify, defend, and hold harmless EcoTurf, its owners, employees, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorney’s fees) arising from:
- Your breach of these Terms
- Your violation of any law or third-party right
- Inaccurate information you provide regarding the project, site conditions, or property ownership
- Failure to disclose known site hazards or underground systems
- Unauthorized modifications to completed work
11. Intellectual Property
All content on the EcoTurf website, including text, graphics, logos, photos, project galleries, designs, video, and proprietary content, is the property of EcoTurf Design & Build or its licensors and is protected by U.S. copyright and trademark laws.
You may not copy, reproduce, distribute, modify, or create derivative works from any website content without our prior written consent. Project designs, renderings, and proposals prepared by EcoTurf for a specific client remain the intellectual property of EcoTurf and may not be used to obtain bids or proposals from other contractors.
EcoTurf reserves the right to photograph and use images of completed projects for marketing, portfolio, and promotional purposes unless the client requests otherwise in writing prior to project start.
12. Cancellations and Refunds
Cancellation terms are set forth in each individual Service Agreement. In general:
- Deposits are non-refundable once design work or material ordering has begun
- Cancellations after work has commenced may result in charges for work completed, materials ordered, and restocking fees
- Texas law provides certain consumer cancellation rights for door-to-door solicited contracts under Texas Business & Commerce Code; these rights, where applicable, will be honored

13. Force Majeure
EcoTurf is not liable for delays or failure to perform caused by circumstances beyond our reasonable control, including but not limited to acts of God, severe weather, fire, flooding, drought conditions affecting installation, supply chain disruptions, government orders, labor shortages, public health emergencies, or other force majeure events. We will make reasonable efforts to communicate delays and resume work as quickly as practical.
14. Communications and Marketing
By providing your contact information, you consent to receive communications from EcoTurf related to your inquiry, project, or account. This includes:
- Project-related emails, calls, and text messages
- Quote follow-ups and consultation reminders
- Occasional marketing communications about our services
Standard messaging and data rates may apply. You may opt out of marketing communications at any time by replying STOP to text messages, clicking unsubscribe in marketing emails, or contacting us at info@ecoturfdesignbuild.com. Opting out of marketing does not affect transactional or project-related communications necessary to deliver our services.
15. Third-Party Services and Links
Our website may include links to third-party websites, social media platforms, review sites, or services. These links are provided for convenience only. EcoTurf does not endorse and is not responsible for the content, privacy practices, or terms of any third-party site.
16. Privacy
Your use of our website and services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. The Privacy Policy is incorporated by reference into these Terms.
17. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms, the website, or any project shall first be addressed through good-faith negotiation between the parties. If unresolved within 30 days, the parties agree to attempt mediation in Dallas County, Texas, before resorting to litigation.
If mediation fails, exclusive jurisdiction and venue for any legal action shall lie in the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction in those courts.
18. Severability and Waiver
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any provision shall not constitute a waiver of that provision or any other provision.
19. Changes to These Terms
We may update these Terms periodically. Material changes will be posted on this page with an updated “Last Updated” date. Continued use of the website or our services after changes are posted constitutes acceptance of the revised Terms.
20. Entire Agreement
These Terms, together with the Privacy Policy and any signed Service Agreement, constitute the entire agreement between you and EcoTurf with respect to your use of our website and our services. They supersede all prior or contemporaneous communications, proposals, or agreements (oral or written).
